MGS Wins Dismissal of Claims Against Title Company
On May 16, 2011, New York State Supreme Court Justice Joan B. Lefkowitz granted summary judgment in favor of MGS client Fidelity National Insurance Co. in the matter entitled Campbell, McMillan, Bosco, Penzel, Danzig & Maker Target Benefit Pension Plan v. Fidelity National Insurance Co., et al. The plaintiff had alleged claims under 18 U.S.C §1962 (the Racketeer Influenced and Corrupt Organizations (“RICO”) Act, in addition to claims for, among other things, fraud, negligence, breach of fiduciary duty and breach of contract. Finding each of the plaintiffs claims deficient, Justice Lefkowitz dismissed the complaint in its entirety.
